Welcome to Pizzaiolo. These Terms and Conditions ("Terms") govern your use of our website located at https://pizzaiolo.ca (the "Site") and all related services provided by Pizzaiolo ("we," "us," or "our").

By accessing or using our Site, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Site or use our services.

These Terms constitute a legally binding agreement between you and Pizzaiolo. Please read them carefully before using our Site or services.

User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Site and for any activities or actions under your password. We encourage you to use a strong password (a combination of upper and lower case letters, numbers, and symbols) for your account.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Acceptable Use

You agree to use our Site and services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates any applicable local, provincial, national, or international law or regulation
• Impersonate or attempt to impersonate Pizzaiolo, a Pizzaiolo employee, another user, or any other person
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site
• Use the Site to send, knowingly receive, upload, download, or use any material that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site
• Attack the Site via a denial-of-service attack or a distributed denial-of-service attack
• Otherwise attempt to interfere with the proper working of the Site

To the maximum extent permitted by law, Pizzaiolo, its directors, employees, partners, agents, suppliers, or affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Site or services
• Any conduct or content of any third party on the Site
• Any content obtained from the Site
• Unauthorized access, use, or alteration of your transmissions or content
• Any errors or omissions in the technical operation of the Site
• Any interruption or cessation of transmission to or from the Site
• Any bugs, viruses, trojan horses, or the like which may be transmitted to or through the Site by any third party

In no event shall our total liability to you for all claims, damages, losses, and causes of action exceed the amount paid by you, if any, for accessing our Site or using our services during the six (6) months prior to bringing such claim.

These limitations will apply even if we have been advised of the possibility of such damages.

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Pizzaiolo, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Site for your personal, non-commercial use only. You must not:

• Modify copies of any materials from this Site
• Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text
• Delete or alter any copyright, trademark, or other proprietary notices from copies of materials from this Site
• Access or use for any commercial purposes any part of the Site or any services or materials available through the Site

If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the Site in breach of the Terms, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

The Pizzaiolo name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Pizzaiolo or its affiliates or licensors. You must not use such marks without the prior written permission of Pizzaiolo.

Our Site may allow you to post, submit, publish, display, or transmit content such as reviews, ratings, comments, or feedback ("User Content"). By providing any User Content on the Site, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material.

You represent and warrant that:

• You own or control all rights in and to the User Content and have the right to grant the license granted above
• All of your User Content does and will comply with these Terms
• User Content is not false, inaccurate, or misleading
• User Content does not violate any law or infringe upon the rights of any third party
• User Content does not contain any material that could be considered harmful, threatening, illegal, harassing, defamatory, obscene, or otherwise objectionable

We have the right, but not the obligation, to monitor and edit or remove any User Content. We take no responsibility and assume no liability for any User Content posted by you or any third party.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Site.

It is your responsibility to review these Terms periodically for changes. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.

These Terms and your use of the Site are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the courts of the Province of Ontario, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
